Creating Swing Beds: Key Regulatory, Operational, Billing and Compliance Considerations Under the CMS Blanket Waivers
On May 20, the Centers for Medicare & Medicaid Services (CMS) released new guidance for hospitals requesting Medicare approval for swing beds as a hospital service. Swing beds provide skilled nursing facility (SNF)-level care for hospitalized patients who do not need acute-level care but cannot find nursing home placement during the COVID-19 public health emergency (PHE).
CMS also issued new blanket waivers to provide flexibilities to care for patients during the COVID-19 PHE. One of these waivers expanded a hospital’s ability to provide long-term care services (swing beds) to patients who do not require acute care but meet the threshold for SNF care. CMS waived certain eligibility requirements for hospital providers of swing beds to allow hospitals to establish swing beds as payable under the SNF prospective payment system (PPS.
This webinar will focus on the swing bed changes promulgated by CMS.CMS completely rewrote all the swing bed regulations and rewrote the Tag numbers. The swing bed interpretive guidelines and survey procedures are now under Appendix PP.
Many CAHs are not aware of these changes or are still struggling to comply. It is challenging to figure out the interpretive guidelines and survey procedure as there is there was no crosswalk between Appendix W – for CAH – and Appendix PP – Long Term Care. This webinar was created to take the mystery out of this. This is a must-attend webinar for any CAHs with swing beds.
Hospitals had seen a significant increase in survey activity by CMS along with an increased number of deficiencies pre-COVID-19. Common deficiencies and how to avoid them will be discussed. Information on how to locate the CAH manual and other resources will be discussed. There will also be a discussion of the 1135 Waivers available to Critical Access Hospitals with Swing Beds.
CMS has a new address to access the CMS manuals and a new email to address questions directly to CMS and both will be included.

Speaker Profile:
Laura Dixon served as the Director, Facility Patient Safety and Risk Management and Operations for COPIC from 2014 to 2020 where she provided safety and risk management consultation and training to facilities, practitioners and staff in multiple states. Ms. Dixon has more than twenty years of clinical experience in acute care facilities, including critical care, coronary care, peri-operative services and pain management. She served as the Director, Western Region, Patient Safety and Risk Management for The Doctors Company, Napa, California. Laura holds a Bachelor of Science degree from Regis University, RECEP of Denver, a Doctor of Jurisprudence degree from Drake University College of Law, Des Moines, Iowa, and a Registered Nurse Diploma from Saint Luke’s School Professional Nursing, Cedar Rapids, Iowa. She is licensed to practice law in Colorado and California.
