Proposition 65: All About California’s Supply Chain Risk Regulation

California Governor Jerry Brown in May 2013 issued principles for reforming Proposition 65. These new regulations became effective on August 30, 2018, and do not apply to the existing inventory. Under these new regulations, a majority of the burden falls on suppliers and distributors. The most important changes focuses on:

• The wording
• The timing of the warning
• The warning application for internet and catalog sales

California Proposition 65, more popularly known as the Safe Drinking Water and Toxic Enforcement Act of 1986, requires businesses to notify people of California about significant amounts of known chemicals that cause cancer or lead to birth defects, or other reproductive harm caused by the products they purchase, in their homes or workplaces, or that are released into the environment via warning labels.

Where products are in violation of the regulation, all the parties involved in the chain of distribution—distributors, suppliers,and end buyers are  liable financially. Knowledge of these requirements and subsequent effective supply chain communication are key to meeting the potential Proposition 65 challenges.
